1. Overview 

This Terms of Service (“Agreement”) governs your use of the Solar Shakti Platform and Services. By accessing the Platform or clicking “I Agree,” you acknowledge that you have read, understood, and agree to be bound by this Agreement. 

The Platform allows users to subscribe to solar energy services by investing in solar kits hosted and managed by Solar Shakti Proenergy Ltd. This document is published in compliance with the Information Technology Act, 2000 and relevant intermediary rules. 

2. Definitions and Interpretation 

• “Agreement”: This Terms of Service document. 
• “User”: Any individual or legal entity accessing or using the Platform. ● “Platform”: www.solarshakti.co.in and associated mobile/web applications. ● “Digital Solar Capacity”: Capacity in kilowatts allocated to a User upon investment. ● “Credits”: Monetary value (currently ₹1,750/month) earned based on energy generation at ₹10/unit. 
• “Dashboard”: A user interface provided for tracking credit generation and investment details. 
• “Project Site”: The physical solar farm hosted by Solar Shakti (currently in Rajasthan). ● “Hosting Partner”: Any third-party location where solar panels are physically installed. ● “Force Majeure”: Events beyond reasonable control. 
• “Applicable Law”: Laws of India including but not limited to IT Act, IBC, RBI guidelines.
  
  
  

• 3. User Eligibility

 

Only individuals above the age of 18 and entities legally capable of entering into contracts may invest and use the Platform. 

4. Solar Kit Reservation 

• Users invest in solar kits at a total cost of ₹60,000 (inclusive of 18% GST and ₹1,000 logistics charge). 
• Kits are hosted by Solar Shakti on your behalf. 
• You do not receive physical delivery or possession of equipment. 
• No government subsidies, resale, or third-party transfers are permitted. 

5. Credit Generation & Payment Terms 

• Each 1 KW kit is expected to generate ~175 units/month. 
• Users earn ₹1,750/month as credit (at ₹10/unit) for 6 years + 4 months as scrap value recovery. 
• Payments are credited monthly to the registered bank account. 
• Performance data is made available via Dashboard. 

6. Activation & Refunds 

• Activation occurs within 5 working days post-payment. 
• Refunds are permitted only before activation. 
• Refund amount excludes logistics and taxes. 
• Post-activation, no refund is applicable unless explicitly agreed in writing. 

7. Platform Access & Use 

• The Platform is provided as-is. 
• Users agree not to misuse, hack, or reverse-engineer the services. 
• Solar Shakti reserves the right to suspend access for violations. 

8. Limitations of Liability

• Solar Shakti is not liable for utility-side failures, transmission losses, or external infrastructure disruptions. 
• Liability is limited to the investment amount minus logistics and tax. ● No guarantee on uninterrupted service or precise monthly output. 

9. Force Majeure 

Solar Shakti shall not be liable for delays or failures resulting from acts beyond its control including but not limited to natural disasters, grid failures, strikes, government actions, or internet outages. 

10. Production Estimates 

• Production estimates are based on industry-standard P50/P90 models. ● P50 = 50% chance system meets or exceeds expected output. 
• P90 = 90% confidence output will meet minimum threshold. 
• 1% annual degradation is considered in forecasts. 

11. Intellectual Property 

• All Platform content, code, visuals, and trademarks belong to Solar Shakti. ● Users are prohibited from copying, redistributing, or misusing any intellectual property. 

12. Indemnity 

Users agree to indemnify Solar Shakti from any losses, legal claims, damages, or liabilities arising from misuse of services or breach of these terms. 

13. Termination 

• Solar Shakti may suspend or terminate any account for violation of terms. ● Termination forfeits future credit rights.

 

14. Insolvency & Liquidation 

• In the event of insolvency, Users will be treated as unsecured creditors. ● Credit balances will be treated as operational debts under IBC guidelines. 

15. Dispute Resolution 

• All disputes shall be subject to arbitration under the Arbitration and Conciliation Act, 1996.

• Language: English 

16. Governing Law 

This Agreement is governed by the laws of India. Jurisdiction lies exclusively with the courts of New Delhi. 

17. Changes to Terms 

Solar Shakti reserves the right to update these terms at any time. Continued use implies acceptance of changes.
